Landlord must pay Tenant $4,290.84 and complete repairs to dishwasher and kitchen cabinet door by September 27, 2024. If repairs not done by deadline, Tenant can deduct $290 per month from rent until work is complete.
Tenant applied for an order determining that Landlord failed to meet the Landlord's maintenance obligations under the Residential Tenancies Act, 2006, specifically regarding the dishwasher and kitchen cabinet door.
Tenant not entitled to abatement for cabinet as it is a minimal cosmetic issue, and Tenant did not grant access for repairs.
Landlord promptly forwarded dishwasher issue to condo property management, who advised it was out of warranty. Landlord asked Tenant to arrange repair as she was out of country. Landlord says Tenant removed part of cabinet laminate himself.
Tenant reported issue with dishwasher on December 4, 2022 and damage to kitchen cabinet prior to October 24, 2021.
