The Landlord's application for eviction is denied on the condition that the Tenant pays $8,796.75 in arrears and costs in installments over 24 months, and pays new rent on time. If the Tenant fails to make the required payments, the Landlord may apply to terminate the tenancy and evict the Tenant.
Considering the Tenant's circumstances, it would not be unfair to grant relief from eviction subject to a repayment plan.
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenant did not void by paying the arrears. The Tenant was still in possession of the rental unit at the time of the hearing.
Landlord's representative said the Landlord would consider a twelve month repayment plan.
Tenant testified that she has regular employment and is the only occupant of the rental unit. She attempted to contact the rent bank for assistance in paying the rental arrears.
