The Landlord has proven on a balance of probabilities the grounds for termination of the tenancy. The tenancy shall terminate on November 30, 2024. If the unit is not vacated by that date, the Landlord may file the order with the Court Enforcement Office (Sheriff) for enforcement. The Tenant shall pay the Landlord $30.25 per day for compensation for the use of the unit from December 1, 2024 until the Tenant moves out.
Tenant has a minor child and is having difficulty finding alternative housing
Landlord applied for an order to terminate the tenancy and evict the Tenant because the Landlord in good faith requires possession of the rental unit for the purpose of residential occupation for at least one year by the Landlord's child.
Landlord testified that his daughter currently lives in Maryland, USA and that she would like to return home to work and live. The rental unit is close to their family home and close to his daughter's in-laws in Toronto.
Tenant takes the position that the Landlord advised her prior to serving the first N12 that he intends to sell the property.
Tenant said she looked for alternative accommodation on Kijiji and Facebook Marketplace, has made three applications without success. The market for comparable housing is limited and expensive.
