The Landlord's application to terminate the tenancy and evict the Tenant for the purpose of personal use by the Landlord's son is granted. However, the Tenant is granted an additional 6 months to find alternative housing due to her personal circumstances.
Tenant has difficulty finding alternative housing due to disability and financial constraints
Landlord applied for an order to terminate the tenancy and evict the Tenant because the Landlord in good faith requires possession of the rental unit for the purpose of residential occupation for at least one year by the Landlord's son.
Landlord's son intends to move into the rental unit after his separation from his spouse. Landlord and his wife are retired and want more privacy and freedom in their own home.
Tenant argued that the N12 notice is defective because it only lists one tenant whereas the lease agreement names five people as Tenants.
Tenant has lived at the rental unit since 2013 and has built a community in the area. Tenant has 3 children, one of whom is getting married and moving out soon. Tenant is on CPP disability and has difficulty finding affordable alternative housing.
