The tenancy is terminated unless the Tenants pay $71,686 to void the order and continue the tenancy by March 25, 2024. If the Tenants do not void the order, they must pay $35,186 to the Landlords and vacate the unit by March 25, 2024. The Landlords are entitled to daily compensation of $180.82 for each day of occupation after March 15, 2024.
Landlords applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants had advised they would vacate the rental unit on March 14, 2024, prior to the hearing date.
Tenants argued that they did not receive a copy of the new rental agreement, and therefore their obligation to pay rent was suspended under section 12(4) of the Act.
