The Landlord's application to terminate the tenancy and evict the Tenant for the purpose of converting the rental unit to commercial use is granted. The eviction is postponed to May 31, 2024. Tenant's long tenancy and difficulty finding affordable alternate accommodation
Landlord applied for an order to terminate the tenancy and evict Tenant because the Landlord requires possession of the rental unit in order to convert the unit to a non-residential use.
Landlord testified that the rental unit is a residential unit located on the second floor of a commercial building with his financial services business being located on the main floor of the building. Landlord requires the rental unit to be vacant because he intends to convert it to commercial use to grow his expanding business.
Tenant requested a refusal of the eviction under section 83(3)(c) of the Act because the Tenant believes that the Landlord is only evicting him for attempting to enforce his legal rights.
Tenant disputed Landlord's intention to convert the rental unit to commercial use and testified that Landlord has other options to expand his business.
