The Tenants proved the Landlord served the N12 notice in bad faith, as the Landlord did not move into the rental unit after the Tenants vacated. The Landlord must pay the Tenants $11,964 for increased rent and moving expenses.
Tenants applied for an order determining that the Landlord gave a notice of termination in bad faith. The Landlord served the Tenants an N12 notice to terminate the tenancy for personal use, and the Tenants vacated the rental unit. The Tenants alleged that the Landlord did not move into the rental unit after they vacated.
Landlord testified it was likely his wife who answered the door on October 15, 2022 and that the red Honda belonged to his wife's relative who frequently visited the rental unit.
Tenants testified they would check on the rental unit after moving out and it appeared vacant until October 1, 2022 when it seemed someone was moving in.
