The Tenant's request to review the order issued on August 30, 2024 is denied. The order is confirmed and remains unchanged. The interim stay order issued on September 10, 2024 is cancelled, and the stay of the original order is lifted on January 31, 2025.
The Landlord applied for an order to terminate the tenancy and evict the Tenant due to persistent late payment of rent. The order was issued on August 30, 2024 with only the Landlord attending the hearing. The Tenant requested a review of the order, alleging that he was under the impression that he had worked out a payment agreement with the Landlord and therefore did not have to attend the scheduled hearing.
Landlord submits that nowhere in the email chain did the Landlord advise the Tenant that the scheduled hearing would be cancelled, nor did the Tenant actually propose a payment plan.
