The Landlord's application is dismissed. The Landlord did not provide sufficient evidence to substantiate the claims for damages to the rental unit or unpaid utility costs. The Tenant shall pay the Landlord $250 for reasonable repair costs and $186 for the application filing fee, for a total of $436.
Landlord applied for an order to terminate the tenancy and evict Tenants due to undue damage to the rental unit and failure to pay utility costs. The Tenants had already vacated the unit prior to the hearing.
Landlord alleged significant damages, including scratches, marker/crayon marks, dog damage, and water damage. Landlord admitted to performing much of the repair work herself.
Tenant acknowledged leaving the unit in a messy state and causing minor damage, but argued that the Landlord exaggerated the extent of the damages.
