The Landlord's request to review order LTB-T-034046-23, issued on June 12, 2024, is granted. The interim order issued on July 10, 2024 is cancelled. Order LTB-T-034046-23, issued on June 12, 2024, is cancelled and replaced with this order. The Tenants' application is dismissed.
Tenants applied for an order determining that the Landlord gave a notice of termination in bad faith. The Landlord requested a review of the order and that the order be stayed until the request to review the order is resolved. The review was heard and the Landlord's request to review the order was granted as the Member erred by not allowing the Landlord to make proper submissions in response to the Member's finding.
The Landlord was not afforded the opportunity to testify regarding the reasons for failing to provide notice to his current landlord to vacate his residence.
