The Landlord must pay the Tenant $8,208.00 by September 17, 2024, which includes $5,160.00 for increased rent the Tenant has to pay for 12 months, $3,000.00 for general compensation, and $48.00 for the cost of filing the application. If the Landlord does not pay the full amount by the due date, they will owe interest at 7.00% annually on the outstanding balance.
Tenants applied for an order determining that the Landlord gave a notice of termination in bad faith. The Landlord served the Tenants with an N12 Notice claiming the Landlord required possession of the rental unit for their own residential occupation. The Tenants vacated the unit as a result of the N12 Notice, but the unit was later listed for rent by the Landlord.
Landlord claimed a change in circumstances, as her original plan was for her niece to live in the unit, but her niece no longer required the unit.
Tenants vacated the rental unit on November 15, 2023 as a result of the N12 notice.
