The tenancy is terminated unless the tenants pay $13,572 by June 30, 2023 or $14,790 by July 6, 2023 to void the order. If the tenants do not pay, they must vacate the unit by July 6, 2023 and pay the landlord $12,594.24 plus daily compensation.
The additional time recognizes the length of the tenancy and provides the Tenants one month from the date of the hearing to find alternate living arrangements for themselves and two children.
The landlord applied for an order to terminate the tenancy and evict the tenants due to non-payment of rent. The landlord served a valid N4 notice, and the tenants did not void the notice by paying the arrears.
The rent arrears accumulated due to a lack of employment and poor spending choices. Only one Tenant is currently working at a hospital and earning a reasonable amount of money each month. The Tenants did not have a good answer for why they had not made any payments to the Landlord since January 27, 2023.
