The Tenant's application is dismissed. The Tenant failed to establish that the Landlord did not occupy the rental unit within a reasonable amount of time after the Tenant vacated, and therefore failed to prove the notice of termination was given in bad faith.
Tenant applied for an order determining that the Landlord gave a notice of termination in bad faith. The Landlord had served the Tenant with an N12 notice to terminate the tenancy for personal use.
Landlord listed the property for sale due to financial issues as another tenant vacated in the residential complex.
Tenant stated that his previous landlord told him the purchaser may be willing to keep him in the unit if he had paid more in the lawful monthly rent.
