The co-op member's occupancy rights are terminated effective December 15, 2024 due to non-payment and persistent late payment of housing charges. The co-op member must pay $14,344 to the co-op by November 25, 2024 to void the eviction order, or $15,766 by November 30, 2024 or $16,988 by December 15, 2024. If the co-op member does not pay, the co-op may file the order with the Sheriff for enforcement starting December 16, 2024.
To allow the co-op member time to make new accommodation arrangements
The co-op applied to terminate the co-op member's occupancy rights and evict her due to non-payment of regular monthly housing charges and persistent late payment of housing charges. The co-op member had been receiving a subsidy for housing charges, but the subsidy was cancelled in September 2023 due to the co-op member's failure to submit required information.
The co-op's Housing Administrator disputed the co-op member's testimony, stating that the previous administrator had mailed the materials to the co-op member and that the current administrator would have provided assistance if requested.
Co-op member testified that she received no request from the co-op for the materials needed for the subsidy assessment, and that she had been submitting the necessary information annually in the past in response to the co-op's requests. She also testified that she did not have access to her mailbox and was unable to reinstate the subsidy.
