Landlord applied for an order to terminate the tenancy and evict the Tenant due to non-payment of rent. The Tenant did not pay the rent arrears by the termination date in the N4 Notice or before the application was filed.
Landlord testified that the Tenant's failure to pay rent jeopardizes the Landlord's ability to provide services for all 40 residents in the care home.
Tenant testified that his agreement with Landlord did not require him to pay any rent beyond what the County of Essex program paid.
