The Landlord's application is dismissed. The Landlord has not proven on a balance of probabilities the grounds for termination of the tenancy. The Tenant is required to pay the Landlord $492.58 in daily compensation for use and occupation of the rental unit for the period from July 1, 2024 to July 11, 2024.
The basement unit is self-contained with no interior access, and the Landlord did not provide viable plans to install a staircase. The Tenant is 81 years old and a long-term tenant since 2015.
Landlord applied for an order to terminate the tenancy and evict Tenant because the Landlord in good faith requires possession of the rental unit for the purpose of residential occupation for at least one year.
