The Landlord has proven the grounds for termination of the tenancy and the claim for compensation. The tenancy is terminated effective May 31, 2024, and the Tenant must pay the Landlord compensation of $31.23 per day starting March 1, 2024 until the Tenant moves out. If the Tenant does not pay the full amount owed by May 31, 2024, the Tenant will start to owe interest at 7% annually on the outstanding balance.
To provide the Tenant additional time to find an alternative rental unit and limit the prejudice to the Landlord
Landlord applied for an order to terminate the tenancy and evict the Tenant because the Landlord in good faith requires possession of the rental unit for the purpose of residential occupation for at least one year.
Landlord testified that he purchased the residential complex in February 2021 and has intended to move into unit #1 as his permanent home since then. Landlord offered the Tenant another 2-bedroom unit in the complex, but the Tenant did not accept it.
Tenant believes the N12 notice was served in bad faith.
Tenant has lived in the rental unit for 7 years and felt harassed and disrespected by the Landlord's repeated attempts to communicate with him about moving out.
