The Landlord's application to terminate the tenancy and evict the Tenant for non-payment of rent was granted. The Tenant may void the order by paying the full amount owing by July 31, 2024 or August 2, 2024. If the Tenant does not void the order, the tenancy will be terminated and the Tenant must vacate the unit by August 2, 2024.
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid N4 Notice, which the Tenant did not void by paying the arrears. The Tenant was still in possession of the rental unit at the time of the hearing.
The Landlord's representative stated that considering the Tenant's payment history and the fact that this is the fourth L1 application filed against the Tenant in the last two and a half years, the Landlord is no longer open to a payment plan. The Landlord requested a standard order, citing the great prejudice that any further delay would cause.
The Landlord's representative stated that after the Tenant fell into arrears, the Landlord spoke with the Tenant on December 5 and December 14, 2023, about the arrears and requested a payment plan. The Landlord also spoke to the Tenant prior to filing the L1 application.
The Tenant stated that he wishes to remain in the rental unit and committed to paying the new rent in full and on time on or before the 1st day of each month starting August 1, 2024. He also proposed a payment plan to address the arrears with a monthly payment of $500.
The Tenant has been before the Board on four separate L1 applications in the last two and a half years, indicating a pattern of not paying rent in full and on time.
