The tenancy will be terminated unless the Tenant pays $17,786 by November 30, 2024 to void the order. If the Tenant does not pay, the tenancy will be terminated, the Tenant must vacate by November 30, 2024, and the Tenant must pay the Landlord $14,977.26 plus daily compensation of $72.33 from October 23, 2024 until the Tenant vacates.
Tenant indicated they had the money to pay the rent arrears, but had been withholding it to try and force the Landlord to address maintenance issues.
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants were still in possession of the rental unit at the time of the hearing.
Tenant testified they had the money to pay the rent arrears, but had been withholding it to try and force the Landlord to address maintenance issues.
Tenant did not provide the required notice and evidence to the Landlord and LTB as per the LTB Rules to raise issues under section 82(1).
