The Landlord's applications are dismissed. There was no tenancy agreement between the parties, and even if a tenancy existed, it would be grossly unfair to require the Tenant to pay rent for a unit he never occupied or had access to.
The Landlord applied for an order to terminate the tenancy and evict the Tenant due to non-payment of rent. The Landlord also applied to terminate the tenancy of the Unauthorized Occupants and seek compensation for their use of the rental unit.
