The Landlord has proven on a balance of probabilities the grounds for termination of the tenancy. The tenancy is terminated May 31, 2025. If the unit is not vacated by that date, the Landlord may file this order with the Court Enforcement Office (Sheriff) so that the eviction may be enforced.
Landlord applied for an order to terminate the tenancy and evict the Tenant because the Landlord in good faith requires possession of the rental unit for the purpose of residential occupation for at least one year. The Tenant did not attend the hearing.
Landlord testified that the rental unit is a two-bedroom, one-bathroom unit located in the basement of her home, she resides on the upper level. The Landlord plans to retire in February 2025 and wishes to have full use of her home. The Landlord also submitted that the Tenant smokes and that because she has a damaged lung, she would prefer to not have the Tenant occupy the basement.
