The Tenant proved the Landlord served the N12 notice in bad faith. The Landlord is ordered to pay the Tenant $9,054.36 for the increased rent and $1,409.50 for moving expenses, plus the application filing fee.
Tenant applied for an order determining that the Landlord gave a notice of termination in bad faith. The Landlord served the Tenant an N12 notice of termination on May 3, 2023 for the purpose of residential occupation by the Landlord's son. The Tenant vacated the rental unit on June 18, 2023, but the rental unit was listed for rent on MLS in August 2023 and rented out for a higher monthly rent.
Landlord claimed his son could not live within 15 kilometers of the Landlord's home due to advice from his holy guru, but did not provide any evidence to support this.
Tenant vacated the rental unit on June 18, 2023 due to the N12 notice.
