Landlord applied for an order to terminate the tenancy and evict Tenants due to persistent late payment of rent. The application was filed after serving a valid N8 notice, which the tenants did not void by paying the rent on time.
Landlord testified he followed fire safety recommendations, the rental unit passed a fire safety check before being rented out, and he promptly attended to fix the oven when first notified.
Tenants argued the landlord is in serious breach of their responsibilities under the Residential Tenancies Act due to issues with the rental unit, including lack of proper fire safety, non-functioning oven, leaks, mold, and lock issues.
Tenants stopped paying rent in September 2024 because they believe the rental unit does not meet fire code requirements. Tenants have only saved a few hundred dollars and have only applied to one other rental property.
