The Landlord proved the grounds for termination of the tenancy. However, the Tenant was granted conditional relief from eviction. The Tenant must return the rental unit to a state of ordinary cleanliness by September 12, 2024 and comply with pest control preparation instructions for one year. If the Tenant fails to comply, the Landlord may apply for an order terminating the tenancy and evicting the Tenant without notice.
Tenant is a single parent of two children with special needs, and the Tenant herself has some medical conditions that have impacted her ability to complete the required tasks within prior specified timelines. The Tenant and the two children would be severely impacted by an eviction.
Landlord applied for an order to terminate the tenancy and evict the Tenant due to the Tenant's failure to properly prepare for pest control treatment, which substantially interfered with the Landlord's lawful right, privilege or interest.
Tenant has recently made progress towards completing the required tasks. The Tenant was very aware of the consequences of non-completion and demonstrated a strong commitment and motivation to complete the required tasks in order to preserve the tenancy.
