Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenant did not void by paying the arrears. The Tenant was still in possession of the rental unit at the time of the hearing.
Landlord stated they had attempted to negotiate a payment agreement with the Tenant but did not succeed. The Landlord has taken out loans to pay the mortgage on the rental unit due to the non-payment of rent by the Tenant.
Tenant stated she had lost her job and currently works part time. She stated she could not afford a payment agreement and also submitted the Landlord had offered her a lump sum amount of money to vacate the rental unit.
