The tenancy is terminated unless the Tenants pay $35,281 to void the order by December 12, 2023. If the Tenants do not pay, they must vacate the unit by December 12, 2023 and pay the Landlord $23,542.33 plus daily compensation.
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.
Tenants made 2 section 82 submissions and any compensation be put towards the rental arrears: 1) Loss of heat when the outside temperature reaches below -10 C when the HVAC system is turned on, full abatement of rent for those months, 2) Harassment by the Landlord and is seeking $10,000.00 in abatement.
