Unless the Tenant voids the order, the tenancy will be terminated effective September 30, 2024. If the Tenant does not void the order, the Tenant is ordered to pay $29,079 to the Landlord, which includes rent arrears up to the hearing date and the cost of filing the application, minus the rent deposit and interest on the deposit. The Tenant is also ordered to pay daily compensation of $59.78 for each day of occupation starting August 1, 2024 until the Tenant vacates the unit.

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears. The tenant was still in possession of the rental unit on the hearing date.
Landlord argued it addressed maintenance issues and was not aware of ongoing problems after 2023.
Landlord's representative submitted evidence of pest treatments, plumbing repairs, and lack of further complaints from Tenant after 2023.
Tenant argued Landlord failed to address maintenance issues as required under the Residential Tenancies Act.
Tenant testified he experienced pest infestation, plumbing issues, heating issues, and ceiling leak, and reported these issues to the Landlord.
