The tenancy will be terminated on June 30, 2023 unless the Tenant pays $5,668.69 by May 31, 2023 or $6,507.16 by June 30, 2023 to void the order. If the Tenant does not void the order, the Tenant must pay $4,286.05 to the Landlord, which includes rent arrears up to the hearing date and the cost of filing the application, minus the rent deposit and interest on the deposit.
The Tenant has resided in the unit for about five years and receives financial assistance from the Ontario Disability Support Program. Additional time is given to the Tenant to either secure alternative accommodation or pay the outstanding amount.
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenant did not void by paying the arrears. The Tenant was still in possession of the rental unit at the time of the hearing.
The Tenant refused to disclose why she fell into arrears, but stated that her caseworkers will assist in getting the arrears paid.
