The Landlords have proven the grounds for termination of the tenancy and the claim for compensation. The tenancy is terminated and the Tenant must vacate the rental unit by December 31, 2024. The Tenant is ordered to pay the Landlords $5,795.10 in compensation for use of the unit from March 1, 2024 to October 21, 2024, minus any rent paid during this period. The Tenant will also pay $24.66 per day from October 22, 2024 until the date the Tenant moves out.
To provide the Tenant with an opportunity to find another residence
Landlords applied for an order to terminate the tenancy and evict the Tenant because the Landlords require possession of the rental unit in order to demolish the unit. The Landlords also claimed compensation for each day the Tenant remained in the unit after the termination date.
Tenant argues the Landlord has no other avenue to evict her, which is why the N13 notice was served.
Tenant disputes the Landlord's application, alleging disrepair in the rental unit, including water leakage and mold in the basement.
