The Landlord's application for eviction is denied on the condition that the Tenants pay $2,806 per month for 6 months starting November 1, 2024, in addition to paying the full monthly rent by the 16th of each month, until the arrears of $16,836 are paid in full. If the Tenants fail to make any of the required payments, the Landlord may apply to terminate the tenancy and evict the Tenants without further notice.
The Tenant has a total monthly income of $9,800 and expenses of $6,450, leaving $3,350 remaining. The Tenant's initial proposed payment plan was found to be unreasonable, so a more reasonable plan was ordered.
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants were still in possession of the rental unit at the time of the hearing.
Landlord's representative submitted the Landlord is seeking a standard 11-day voidable order, as the Tenant has been behind on rent for some time and previous attempts of repayment have not been followed.
Tenant argued they could pay $1,200 towards the arrears monthly, in addition to the full rent each month, until the arrears are paid off.
Tenant submitted they would like to stay in the unit and proposed a payment plan to pay back the arrears owed to the Landlord and continue the tenancy.
