We estimate Application Date using rent arrears.
The tenancy will be terminated on October 31, 2024 unless the Tenant voids the order by paying $9,642.50 by that date. If the Tenant does not void the order, they must vacate the unit and pay the Landlord $4,118.52, plus daily compensation of $73.73 from September 18, 2024 until the date they move out. The Tenant's request to raise tenant's rights issues under section 82 was denied due to failure to provide proper notice and evidence.

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenant did not void by paying the arrears. The Tenant was still in possession of the rental unit at the time of the hearing.
Landlord submitted that the Tenant's proposed payment plan would take too long to complete at 14 months, and that the Tenant has only made 1 payment since the application was filed despite previous promises to pay rent.
Tenant testified that she lives in the rental unit with her husband and two children, and that their current household income is $6,000 per month. Tenant stated she fell into arrears due to becoming unemployed, but her husband is currently working and she recently received a job offer.
