The tenancy will be terminated unless the Tenants pay $6,893.40 by October 31, 2023 or $8,380.22 by November 6, 2023 to void the order. If the Tenants do not make the required payment, the tenancy will be terminated, and the Tenants must vacate the unit by November 6, 2023. The Landlord is entitled to the rent arrears, application filing fee, and compensation for the Tenants' continued occupation of the unit.
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants were still in possession of the rental unit at the time of the hearing.
Tenants claimed they had a verbal agreement with the former landlord to replace the flooring and deduct the cost from the rent.
