The Board denied the Landlord's application for eviction due to the Landlord's illegal lockout of the Tenants. The Board ordered the Landlord to immediately provide the Tenants with keys and allow them to recover possession of the rental unit. The Board also ordered the Landlord to pay an administrative fine of $5,000 and refund the Tenants $720 in unlawfully collected late fees. The Tenants were ordered to pay the Landlord $5,583.75 less $98.63 per day for each day they remained out of possession.
Landlord's illegal lockout of Tenants
Landlord applied for an order to terminate the tenancy and evict Tenants due to non-payment of rent. Tenants filed a s.82 claim alleging the Landlord illegally locked them out of the rental unit.
Landlord stated he found the rental unit in a 'deplorable' condition and felt it was necessary to change the locks.
Tenants argued the Landlord illegally locked them out of the rental unit, contrary to s.24 of the Residential Tenancies Act, 2006.
Tenant Christina Teskey testified that the Landlord locked the Tenants out of the rental unit on August 15, 2024.
