The Landlord has proven on a balance of probabilities the grounds for termination of the tenancy due to the Tenant committing an illegal act. The tenancy is terminated and the Tenant must move out by September 15, 2024. The Landlord is entitled to $186 for the application fee, and the Tenant is owed $481.49 for the rent deposit and interest.
The Landlord applied for an order to terminate the tenancy and evict the Tenant because the Tenant or another occupant of the rental unit has committed an illegal act or has carried out, or permitted someone to carry out an illegal trade, business or occupation in the rental unit or the residential complex.
Tenant argued his conduct was in self-defense and due to his bipolar disorder.
Tenant assaulted two other tenants on January 19, 2024, causing injuries.
