The tenancy is terminated effective September 29, 2024. The Tenant must pay the Landlord $35,186.00, which includes rent arrears and the application filing fee, minus the rent deposit and interest. The Tenant must also pay daily compensation of $95.34 starting September 4, 2024 until the unit is vacated. If the Tenant does not pay the full amount by September 29, 2024, the Landlord may file the order with the Court Enforcement Office for enforcement.
Tenant's circumstances did not warrant relief from eviction
Landlord applied for an order to terminate the tenancy and evict the Tenant due to non-payment of rent and persistent late payment of rent. The Tenant requested a review of the initial order, which was granted. The matter was then heard de novo.
Landlord's representative submitted that an eviction order is necessary due to the significant arrears accumulated by the Tenant.
Tenant explained his prolonged unemployment due to an accident has hindered his ability to pay rent in full and on time.
