The Landlord has proven the grounds for termination of the tenancy and the claim for compensation. The tenancy is terminated as of November 30, 2024. The Tenants must pay the Landlord $35,000 in compensation for use of the unit, plus daily compensation of $116.71 from August 2, 2024 until the date they move out. The Landlord must pay the Tenants $3,320.74 for the rent deposit and interest. If the Tenants do not pay the full amount owing by December 31, 2024, they will owe interest at 6% annually on the outstanding balance.
Eviction postponed to November 30, 2024 to allow more time for Tenants to vacate
Landlord applied for an order to terminate the tenancy and evict Tenants because the Landlord in good faith requires possession of the rental unit for the purpose of residential occupation for at least one year.
Landlord severed the commercial portion of the unit and rented it out to another party, 'double-dipping' by claiming compensation.
Tenants were unable to pay rent due to COVID-19 impact on their barber shop business.
Tenants argue N12 notice should have specified 'upper unit'.
