The Landlord's application to terminate the tenancy and evict the Tenants was dismissed. However, the Tenant was ordered to have the carpets professionally cleaned and the walls professionally washed by November 30, 2024. If the Tenant fails to comply, the Landlord may apply for an order terminating the tenancy and evicting the Tenant.
Damage was simple wear and tear, not negligent
Landlord applied for an order to terminate the tenancy and evict Tenants due to alleged wilful or negligent damage to the rental unit. The Landlord claimed there was damage to trims, baseboards, paint, carpet, and other issues. The Tenants had been in the unit for 5 years and had a pet.
Tenant testified there was a flood due to washing machine upstairs 2.5 years ago, and Landlord said they would do an inspection but did not.
