The Landlord's application is granted. The tenancy is terminated, and the Unauthorized Occupants must vacate the rental unit by August 26, 2024. The Unauthorized Occupants must pay the Landlord $45.86 per day for compensation for the use of the unit from June 7, 2024 until they move out. The Tenant must pay the Landlord $201.00 for the cost of filing the application.
Landlord applied for an order to terminate the tenancy and evict the Tenant and Unauthorized Occupants because the Tenant transferred occupancy of the rental unit to the Unauthorized Occupants without the Landlord's consent.
Landlord's agent testified that site staff became aware of someone other than the Tenant residing in the unit. Landlord's resident manager testified that he noticed occupants coming in and out of the unit who were not the Tenant, and they informed him that they found the apartment on a site called Toronto Furnished Living and were paying approximately $1,600.00.
Tenant testified that the occupants in the unit are his roommates, and his lease has not been transferred to anyone. He testified that all his clothes are there, although he is not currently living in the unit. He testified that he is living at another location with his wife and children.
