The Tenant's request for review is denied. However, the original order contained serious errors regarding the rent arrears owed by the Tenant. The order is varied to reflect that the Tenant had a negative balance of $(823.25) at the hearing date. The stay of the original order is lifted on December 31, 2024.
Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent and persistent late payment of rent. The original hearing was held on July 4, 2024, with only the Landlord's representative attending. The order was issued on August 6, 2024. The Tenant requested a review of the order and a stay, which was granted on August 21, 2024. The review hearing was held on November 7, 2024.
Landlord opposed the adjournment request and submitted that the Tenant had adequate opportunity to prepare and consult with counsel.
Tenant testified she mistakenly noted the incorrect hearing date on her calendar and was not reasonably able to participate in the original hearing.
