The tenancy will be terminated unless the Tenant pays $3,291.03 by September 30, 2023 or $4,850.06 by October 12, 2023 to void the order. If the Tenant does not pay, they must vacate the unit by October 12, 2023. The Landlord is entitled to deduct daily compensation from the rent deposit starting August 15, 2023.
The rent owing is for one month and it would not be unreasonable to provide the Tenant with a brief period of time to preserve their tenancy. Prejudice to the Landlord is minimized as the voiding period is one month and the Landlord holds a rent deposit in this amount.
Landlord applied for an order to terminate the tenancy and evict the Tenant due to non-payment of rent. The Landlord also claimed charges related to NSF cheques.
