The Tenants transferred occupancy of the rental unit to the Unauthorized Occupants in a manner not authorized by the Act. The Landlord is entitled to compensation from the Unauthorized Occupants for the use and occupation of the rental unit from September 1, 2024 to October 31, 2024. The Tenants are jointly and severally liable for the application filing fee.
Landlord applied for an order to terminate the tenancy and evict the Tenants and Unauthorized Occupants because the Tenants transferred occupancy of the rental unit to the Unauthorized Occupants without the Landlord's consent.
Landlord discovered Unauthorized Occupants in the rental unit and took steps to file this application. Landlord did not authorize the Tenants to sublet the rental unit or transfer occupancy to the Unauthorized Occupants.
Tenants dispute they should pay compensation as they had paid rent to August 31, 2024 and have no more money, and Sajal Ahmed should be responsible as he rented the unit out without their knowledge or consent.
Tenants did not reside in the rental unit and transferred occupancy to Unauthorized Occupants without Landlord's consent.
