The Landlord's application to terminate the tenancy and evict the Tenant due to substantial interference is granted. The Tenant must vacate the rental unit by November 5, 2024. The Tenant owes the Landlord $32,962.38, which includes compensation for use and occupation of the unit and the application filing fee. If the Tenant does not pay the full amount by November 5, 2024, they will owe interest at 6% annually on the outstanding balance.
Landlord applied for an order to terminate the tenancy and evict the Tenant due to the Tenant substantially interfering with the Landlord's legal rights, interest and privileges. The Landlord alleged that the Tenant failed to properly manage garbage and litter at the rental property, which resulted in complaints from the City of Toronto and neighboring tenants.
Landlord testified that he recently visited the property in April 2024 and observed a large amount of garbage, which he had someone assist in removing. Landlord also stated that the City of Toronto and neighbors complained about the excessive garbage.
Tenant requested 6 months or until December 31, 2024 to allow subtenants, who are students, time to find alternate accommodations.
Tenant does not dispute the issues that gave rise to the N5 notices, but denies accountability for the issues.
