The tenancy is terminated as of March 14, 2024, the date the Tenant vacated the rental unit. The Tenant is ordered to pay the Landlord $15,414.52, which includes rent arrears up to the move-out date and the application filing fee. If the Tenant does not pay the full amount by September 30, 2024, they will owe interest at 7% annually on the outstanding balance.
Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. The Landlord served a valid N4 Notice, which the Tenant did not void by paying the arrears. The Tenant vacated the unit on March 14, 2024, but the Landlord claimed rent arrears up to that date.
Landlord testified she only changed the lock on the front door, as Tenant had previously changed the locks himself. Landlord attempted to provide Tenant with new keys, but he did not respond.
Tenant argued he should not be liable for rent arrears beyond August 2, 2023, since he was denied access to the unit from that date.
Tenant claimed Landlord changed locks, preventing him from re-entering the unit. Tenant admitted to never informing Landlord he had vacated.
