The Landlord must return the $2,300 LMR deposit to the Tenant. The Landlord unilaterally and in breach of the Act attempted to end the tenancy by forcing the Tenant out in less than 30 days without proper process.
Tenants applied for an order determining that the Landlord collected or retained money illegally. The Landlord did not use the Tenant's rent deposit to pay for the last rental period of the tenancy and did not return the deposit to the Tenant, which is prohibited by the Residential Tenancies Act, 2006.
Landlord claimed there was a linguistic misunderstanding about selling the house and the Tenant having to vacate the unit.
Tenant was asked to vacate the unit in a manner that did not comply with the Act. Landlord unilaterally attempted to end the tenancy by forcing the Tenant out in less than 30 days without proper process.
