The Divisional Court dismissed the tenant's appeal of the LTB decision to terminate tenancy and evict. The Court found no error of law in the LTB's conclusion that the tenant was responsible for illegal interference with the hydro supply. The eviction order was upheld, with enforcement delayed until November 30, 2019.
Landlord filed two applications to terminate tenancy and evict tenant: L1 for non-payment of rent, and L2 for illegal act (interference with hydro supply). Tenant appealed LTB decision to Divisional Court.
