The Landlord has proven on a balance of probabilities the grounds for termination of the tenancy. The tenancy shall be terminated effective February 28, 2025. If the unit is not vacated by that date, the Landlord may file the order with the Sheriff for enforcement. The Landlord shall provide the Tenant with one month's rent compensation by November 30, 2024. The Tenant shall pay the Landlord $36.53 per day for each day the Tenant remains in the unit after the termination date.
The Tenant is 66 years old, has lived at the rental unit since 2014, and has ties to the community. The Tenant has been unsuccessful in finding alternative affordable housing. The Landlord has temporary options, such as staying with her sister, while the Tenant would face significant hardship in having to move.
Landlord applied for an order to terminate the tenancy and evict Tenant due to the Landlord's good faith requirement of the rental unit for the purpose of residential occupation for at least one year.
The Landlord intends to move into the rental unit as she currently lives in the marital home with her ex-husband, who works primarily in the United States. The Landlord has received an N12 notice to terminate her tenancy at the marital home.
The Tenant believes the Landlord does not intend to live in the rental unit and the N12 notice was not served in good faith.
The Tenant believes the N12 notice was served in retaliation for the Tenant's past complaints about issues such as parking, a barbecue, garbage, and skylights.
