The Tenants proved the allegations contained in the application on a balance of probabilities. Therefore, the Landlords must pay the Tenants $7,993.97, which includes $6,600 for increased rent, $1,340.97 for moving and storage expenses, and $53 for the cost of filing the application.
James Cote and Melissa Cote (the 'Tenants') applied for an order determining that Jatinder Sign Grewal and Jaspreet Kaur Dhanoa (the 'Landlords') gave a notice of termination in bad faith.
Landlords claim there was a change in circumstances as the mother-in-law was in an accident and could not move in as planned. Landlords assert they were transparent with the Tenants and did not have bad faith intentions.
Landlords served an N12 notice on May 1, 2022 with a termination date of July 1, 2022, stating that a parent would be moving into the rental unit. On May 19, 2022, the Landlord advised the Tenants that his mother-in-law would no longer be moving in until late fall, and the Tenants could continue to remain in the unit until then. However, the Tenants had already signed a new lease and did not want to risk losing the new property.
Tenants vacated the rental unit on June 15, 2022 based on the N12 notice.
