The tenancy is terminated unless the tenant pays $13,786 by April 30, 2023 or $15,086 by May 7, 2023 to void the order. If the tenant does not pay, they must vacate the unit by May 7, 2023 and pay the landlord $13,041.62 plus daily compensation of $42.74 from April 14, 2023 until the date they move out.
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.
Tenants did not pay rent and had issues with flooding, mold, and moisture in the rental unit.
