The Landlord has proven on a balance of probabilities the grounds for termination of the tenancy. The Tenant must move out of the rental unit on or before January 31, 2025. The Tenant shall pay the Landlord compensation of $36.16 per day for the use of the unit starting August 10, 2024, until the date the Tenant moves out. The Landlord shall apply the amount held as a last month's rent deposit towards the rent for the rental period starting January 1, 2025, and ending January 31, 2025. The Landlord owes the Tenant $38.73, which is the amount of the interest on the last month's rent deposit. The Landlord shall also pay the Tenant the amount of $1,100.00 on or before December 31, 2024.
Provide Tenant additional time to find alternate housing
Landlord applied for an order to terminate the tenancy and evict Tenant because the Landlord in good faith requires possession of the rental unit for the purpose of residential occupation for at least one year.
Landlord sold previous home in August 2023 and moved into basement of niece's home, intending it to be temporary. Landlord seeks larger space and privacy by moving into the rental unit.
Tenant believes Landlord is evicting to sell the property for financial gain, not for personal use.
Tenant lives alone and has occupied the rental unit since March 2023. Tenant sometimes left the door to the residential complex open for air flow. Tenant had a strained relationship with upstairs neighbor but it has improved. Tenant did not seek to move out due to financial constraints.
