The Landlord's application to terminate the tenancy and evict the Tenant is granted. The Tenant must move out by August 31, 2024. The Tenant owes the Landlord $3,269.83, which includes compensation for use of the unit and the application filing fee, minus the rent deposit and interest. If the Tenant does not pay the full amount by July 31, 2024, they will start owing interest at 7% annually on the outstanding balance.
The Tenant is a single father with children residing in the unit 50% of the time, and does not currently drive, so moving out may cause them to lose their job and risk becoming homeless.
Landlord applied for an order to terminate the tenancy and evict the Tenant because the Landlord in good faith requires possession of the rental unit for the purpose of residential occupation for at least one year by the Landlord's spouse's parents.
The Landlord Alwin Cheung (AC) testified he advised the Tenant by text message and email on March 8, 2024, that the rent for February 2024 would be waived in lieu of compensation.
The Tenant's Legal Representative submitted that the Landlord failed to provide compensation in an amount equal to one month's rent, and that the Landlord's application should be dismissed on that basis.
The Tenant submitted that they require additional time to move out of the rental unit but could not indicate how much time is needed. The Tenant also indicated that they are a single father, that their children reside in the rental unit with him 50-percent of the time, and that while work and their children's schools are nearby, they do not currently drive.
